STORE TERMS AND CONDITIONS

The owner of the online store www.elar-tech.pl is Elar-tech PHU, 43-190 Mikołów, ul. Podleska 26. Tax Identification Number (NIP): 9541209319, National Business Registry Number (REGON): 241320985.

 

Anyone who reads the terms and conditions below and correctly completes the registration form can become a customer of our store.

 I. Placing Orders

  1. To make a purchase, please submit a correctly completed registration form. Orders can be placed 24/7.
  1. Customers registered in our database can register in the store by providing only their Login and Password.
  1. Immediately after submitting your order, you will receive an "Order Confirmation" via email.
  1. Once your order has been verified by our sales representative, you will be sent an "Order Confirmation" specifying the exact delivery date.
  1. Please provide your current phone numbers for order verification purposes!
  1. Each shipment is accompanied by a VAT invoice or receipt.
  1. Placing an order constitutes the Buyer's acceptance of these Terms and Conditions.
  1. Placing an order also constitutes consent to the issuance of a VAT invoice without the recipient's signature or receipt.

 II. Order Fulfillment

  1. Orders placed by 2:00 PM will be processed the same day (this does not apply to days when the warehouse is closed).
  1. Standard orders are processed within 24 hours.
  1. If an item is out of stock, the delivery deadline may be extended (3-7 days), of which you will be informed immediately.
  1. Each customer is informed of the shipment of the goods by email or telephone.
  1. Orders will be processed in the order in which they are received.
  1. ELAR-TECH PHU reserves the right to verify the order and cancel it in any case if there is any doubt as to its accuracy.
  1. If the customer chooses payment by bank transfer or payment card, the order processing time is counted from the date of crediting the Seller's bank account or settlement account.

III. Prices and Discounts

  1. All base prices for goods listed in the store are net prices; the gross price is indicated in smaller font.
  1. When placing an order in Euro, the fixed exchange rate of PLN 4.0000 applies.
  1. Every professional customer can count on favorable discounts. Discounts are granted based on the number of orders and their value. 23% VAT must be added to all prices.
  1. Part prices do not include shipping costs or any deposits (for certain items).
  1. ELAR-TECH PHU reserves the right to change prices in the Online Store.

 IV. Warranty

  1. All goods offered in our store are covered by a MANUFACTURER'S warranty for remanufactured and new parts!
  1. The manufacturer's warranty lasts 6 months from the date of purchase.

 V. Statutory liability for defects

  1. The Seller is obligated to deliver the product subject to the contract free of defects.
  2. The Seller is liable under the warranty for physical defects that existed at the time the risk passed to the buyer or resulted from a cause inherent in the item sold at the same time – for a period of 2 years.
  3. The Seller informs that in the case of products covered by the warranty, the buyer's rights and the guarantor's obligations in this respect are defined and must be performed in accordance with the terms set out in the warranty card. The warranty granted for the sold product is an additional right and does not exclude, limit, or suspend the consumer's rights under the provisions of the warranty for defects in sold items (Article 577 of the Civil Code).
  4. The Seller is released from liability under the warranty if the consumer was aware of the defect at the time the contract was concluded.
  5. If a defect or non-conformity of the delivered product with the contract is discovered, the consumer has the right to file a complaint.
  6. Defective product – in agreement with the seller, if possible and reasonable, the consumer exercising warranty rights will be obligated to deliver the item at the seller's expense to the place specified in the sales contract, or if no such place is specified in the contract, to the place where the item was delivered to the consumer. If, due to the nature of the item or the manner of its installation, delivery of the item by the customer would be excessively difficult, the customer is obligated to make the item available to the seller at the place where the item is located.
  7. If the sold item has a defect, the customer may submit a declaration requesting a price reduction or withdrawal from the contract, unless the seller immediately and without undue inconvenience to the buyer replaces the defective item with a defect-free one or removes the defect. This limitation does not apply if the item has already been replaced or repaired by the seller, or if the seller has failed to fulfill the obligation to replace the item with a defect-free one or remove the defect. 8. If the buyer is a consumer, they may request replacement of the item with a defect-free item instead of the removal of the defect proposed by the seller, or request removal of the defect instead of replacement, unless bringing the item into conformity with the contract in the manner chosen by the buyer is impossible or would require excessive costs compared to the method proposed by the seller. When assessing whether the costs are excessive, the value of the item free of defects, the type and significance of the defect, and the inconvenience to which the buyer would be exposed by another method of satisfaction are also taken into account.
  8. The reduced price should be in proportion to the price resulting from the contract, in which the value of the item with the defect is in proportion to the value of the item without the defect.
  9. The buyer may not withdraw from the contract if the defect is insignificant.
  10. The seller will review the complaint without undue delay. No later than within 14 calendar days from the date of receipt of the complaint, and will inform the consumer in writing or electronically within that time about the status of the complaint. Leaving the complaint unanswered within this time period is deemed to be acknowledgment of the complaint.
  11. If the complaint is upheld, the seller will reimburse the consumer for the costs incurred in connection with the complaint. The seller will transfer the amount due to the consumer to the seller's bank account or by postal order.
  12. If the acceptance of the complaint requires repair or replacement of the goods, the seller will return the goods to the consumer at its own expense.

 VI. Transport

  1. Ordered goods are delivered via DPD or InPost courier at the recipient's expense.
  1. If the Customer selects the "personal collection" option, they can collect the goods from the main warehouse in Mikołów after receiving confirmation that the goods are ready for collection.
  1. The shipment will be sent to the address you provided in the registration form.
  1. We do not process orders without a contact phone number.
  1. Returns within 14 days apply only to consumers.
  1. Upon receipt of the shipment, it should be immediately inspected in the presence of the courier. If any damage is found, a damage report should be completed upon receipt. If the report is completed after the courier's departure, we do not guarantee a successful complaint.

 

VII. Payments

  1. The entity providing online electronic payments is Blue Media S.A.
  1. Available payment methods for card payments:

Payment cards: Visa, Visa Electron, MasterCard, MasterCard Electronic, Maestro

 

If a refund is required for a transaction made by a customer with a payment card, the seller will refund the amount to the bank account assigned to the Customer's payment card.

 

VIII. Personal Data Protection

  1. Personal data is collected from you voluntarily and is used for the purpose of fulfilling orders, issuing invoices, delivering goods, receiving payments, and potentially refunding funds. The personal data controller is Elar-Tech PHU, which makes every effort to ensure that this data is stored in accordance with the Personal Data Protection Act, Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016.
  1. You have the right to access and correct your personal data at any time. To do so, please contact us.
  1. Elar-Tech also uses the personal data of its customers to send commercial offers. Receiving such information is entirely voluntary and may be discontinued at any time upon your request.
  1. All data collected from you is used solely for the purposes listed above and is not used for any other purposes.
  1. If you believe that the processing of your personal data by our company violates the provisions of the GDPR, you have the right to lodge a complaint with the President of the Personal Data Protection Office.
